Welcome to PropertyListings. These Terms of Service (the “Terms”) govern your access to and use of the PropertyListings website, applications, and services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who can use the Service
You must be at least 18 years old and capable of forming a binding contract under the laws of the Republic of the Philippines to use the Service. By using the Service, you represent that you meet these requirements.
If you are using the Service on behalf of a brokerage, agency, or other organization, you represent that you have authority to bind that organization to these Terms.
2. Accounts
You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us immediately if you believe your account has been compromised. We may suspend or terminate accounts that violate these Terms.
3. Listings and your content
The Service lets you create property listings, generate AI-assisted marketing materials, and publish a shareable public page. You retain ownership of the content you upload (photos, descriptions, contact information). By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to host, display, format, and distribute that content as needed to operate and promote the Service.
You represent and warrant that, for each listing you publish:
- You have the right to market and sell or lease the property.
- You have permission to use any photos and media you upload.
- All information you provide is accurate, current, and not misleading.
- The listing complies with all applicable Philippine real estate laws and regulations, including the Real Estate Service Act (R.A. 9646) where applicable.
AI-generated content
Descriptions, captions, and other marketing assets are generated with the help of AI models. You are responsible for reviewing all AI-generated content for accuracy, completeness, and compliance with applicable rules before publishing or sharing it.
4. Credits and payments
The Service uses a credit system. 1 credit lets you create 1 new listing. Credits can be purchased in packs through our hosted checkout. Once purchased, credits are added to your account balance and do not expire.
Prices are shown in Philippine Peso (PHP) and are inclusive of applicable taxes unless stated otherwise. Promotional pricing (such as launch discounts) is available only for the period stated on the pricing page and may be changed or ended at our discretion.
Refunds, where available, are governed by our Refund Policy.
5. Acceptable use
You agree not to use the Service to:
- Post listings for properties you do not have the right to market.
- Upload content that is unlawful, deceptive, defamatory, infringing, or harassing.
- Misrepresent property details, prices, ownership, or your relationship to the property.
- Scrape, mirror, or otherwise extract data from the Service without our written permission.
- Attempt to reverse engineer, probe, or disrupt the Service or its infrastructure.
- Send spam or unsolicited communications to other users or visitors.
- Use the Service to circumvent legal or regulatory obligations.
We may, at our discretion, remove listings, suspend access, or terminate accounts that we believe violate these rules.
6. Third party services
The Service relies on third party providers, including hosting (Supabase), payment processing, mapping, and AI providers. Their availability and performance can affect the Service. Your use of any third party tool linked from the Service may also be subject to that provider’s own terms.
7. Intellectual property
The Service, including its design, software, branding, and underlying technology, is owned by PropertyListings and protected by intellectual property laws. Except for the rights explicitly granted in these Terms, no rights are transferred to you.
8. Disclaimer
The Service is provided on an “as is” and “as available” basis. We do not warrant that the Service will be uninterrupted, error free, or free from security incidents. We do not verify, endorse, or guarantee the accuracy of property listings or the identity of users. Buyers, renters, and other visitors should verify all information independently and exercise their own judgment before transacting.
9. Limitation of liability
To the maximum extent permitted by law, PropertyListings will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising out of or in connection with the Service. Our total liability for any claim arising out of or relating to the Service is limited to the amounts you paid us in the 12 months preceding the event giving rise to the claim, or PHP 5,000, whichever is greater.
10. Indemnity
You agree to indemnify and hold PropertyListings harmless from any claim, loss, or liability arising out of (a) the content you upload or publish, (b) your violation of these Terms, or (c) your violation of any law or the rights of any third party.
11. Termination
You may stop using the Service at any time and delete your account from your dashboard. We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms or for any other reason permitted by law. Sections that by their nature should survive termination will continue to apply.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date above and, for material changes, give you reasonable notice. Your continued use of the Service after the changes take effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict of laws principles. Any dispute arising from these Terms or the Service will be submitted to the exclusive jurisdiction of the competent courts of Metro Manila, Philippines, unless required otherwise by applicable consumer law.
